Why File a Patent?

The enumerated powers in Article I, Section 8 of the United States Constitution empowers the United States Congress to:

“To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries.”

 

Fundamentally, the unique ideas of inventors are property and one of the primary purposes of our Constitution is to protect individual property rights. This is the source of the term “intellectual property”.

 

Why file a patent? Patent law benefits our society by encouraging inventors to invent and share their ideas with others. If an individual is able to enjoy the fruits of their ideas and efforts, more people will invent. This has been a driving force in the U.S. economy since its founding and has led to the greatest standard of living of any human civilization.
